Apex Terms and Conditions of Sale | FV Prod

Effective as of June 20, 2026 These Terms and Conditions of Sale (hereinafter "Terms") apply to all sales of software and digital content completed through the website apex.fvprod.fr. Article 1 - Site Publisher and Purpose The website apex.fvprod.fr is published by Fvprod Apex, EI, registered with the Épinal Trade and Companies Register (RCS) under number 829 489 574, with its registered address at c/o Arnaud Frey, 63 avenue de la Résistance, 77500 Chelles, France. For any inquiries, the Publisher can be contacted by phone at +33 7 49 98 02 33 or by email at contact@fvprod.com. The purpose of these General Terms and Conditions of Sale (GTC) is to define the conditions for the online sale of software solutions (notably Dual AI Studio NDI Edition) offered by the Seller. Article 2 - Pricing and Payment Prices are listed in Euros on the product description page. Payment is due immediately upon ordering and is processed via secure payment methods available on the website. Article 3 - Software Delivery Delivery is carried out exclusively through digital channels (via download link or issuance of an activation key) sent to the e-mail address provided by the Client. Article 4 - Hardware Compatibility The Client acknowledges having reviewed the mandatory hardware configuration required prior to purchase. Our software (specifically Dual AI Studio NDI Edition) may carry strict execution restrictions, such as exclusive compatibility with Apple Silicon processors. No refund will be granted for any incompatibility related to the Client's hardware. Article 5 - Absence of Right of Withdrawal and Refunds In accordance with Article L.221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts involving the supply of digital content not provided on a tangible medium, where the performance has begun after the consumer's express prior consent and express waiver of their right of withdrawal. IMPORTANT: By validating the order and downloading or accessing the software, the Client expressly consents to the immediate execution of the contract and formally waives their 14-day right of withdrawal. Consequently, no right of withdrawal applies, and no refund will be issued once the software accesses or activation keys have been provided. Article 6 - Intellectual Property Purchasing a software license grants a personal, non-exclusive, non-transferable, and time-limited right to use the software (e.g., 1 year of included updates). Any reproduction, modification, disassembly, or resale is strictly prohibited. Article 7 - Governing Law These Terms are governed by French law. In the event of a dispute, French courts shall hold exclusive jurisdiction.
